You must read the general terms and conditions of sale and use (hereinafter referred to as "T&Cs") outlined below before using this site.
These T&Cs exclusively govern the sale of our products on the sdtailing.com site. Consequently, purchasing our products implies full and unconditional acceptance of the T&Cs by the buyer. The validation of the buyer's order on the site constitutes acceptance of the T&Cs. Unless proven otherwise, the data recorded on the site serves as proof of all transactions between our company and the buyer.
Any access to or use of the site implies compliance with and acceptance of all the T&Cs. If you do not wish to accept all or part of them, you are asked to refrain from using this site.
Shine reserves the right to modify the terms, conditions, and notices of these T&Cs. These changes are deemed accepted without reservation as soon as you access the site after they are posted online.
You acknowledge that these General Terms and Conditions of Sale and Use constitute a complete and exclusive agreement between you and Shine regarding your use of the site.
All products and samples available on the site (hereinafter referred to as "Products") are intended for personal use only. You therefore agree not to sell or resell the Shine products and samples that you purchase or receive.
Shine reserves the right to cancel, limit, or reduce the quantity of any order that may be placed in violation of these T&Cs.
Orders
The buyer can only place an order online if they have completed the order form on the site. Orders placed on the site are recorded upon validation by the buyer (by clicking the "Validate" button). However, the order becomes final only when it has been confirmed by our company.
A detailed description of the Products is available when each one is viewed individually on the site.
The system in place requires an active approach from you. It complies with the legal requirements for online sales and consumer protection.
Our product offers and their prices are valid as long as they are visible on our site, subject to available stock. In the event of unavailability of one or more products after the buyer's order is placed, except in cases of force majeure, the buyer will be informed immediately and will have the option to cancel their order. Refunds of the amounts paid will then be made by credit to the buyer's bank account or by bank check sent to their billing address within 30 days from the payment of the price by the buyer.
When placing your order, we inform you of the availability of the products you wish to purchase. If the selected items are in stock, Shine will process the orders the day after they are recorded and will deposit the packages with the chosen carrier for shipment within 48 hours. Orders placed on Friday, Saturday, or Sunday are processed the following Monday. Orders placed on a public holiday are processed the next business day. If the entire order is not available, our company will contact the buyer to offer a replacement product. If the buyer refuses, our company will either refund the unavailable products or send them in separate shipments, depending on the buyer's choice, except on Saturday, Sunday, or public holidays.* We invite you to follow the delivery information.
If payment is made by check, the order will only be processed upon receipt and clearance of the check. Consequently, the delivery time will start from the date the check is cleared and may be modified accordingly.
Prices and Delivery
Product prices are indicated in euros and include handling, packaging, and product preservation fees, but do not include shipping costs, which may vary depending on the order amount, weight, and/or destination country. Any order delivered outside of mainland France may be subject to local taxes and customs duties at the buyer's sole expense.
Prices are valid on the date of order validation. These prices may be changed without notice.
The price indicated in the order confirmation is the final price expressed excluding VAT (non-recoverable VAT under Article 293 B of the CGI).
Discounts are not cumulative.
Shine offers several delivery methods:
Standard home delivery in mainland France to the address indicated by the customer, with delivery to the mailbox without signature, subject to the buyer's payment of the applicable Colissimo La Poste or DPD shipping rates.
Standard delivery in mainland France to a relay point specified by the customer during the order on the Shine website, subject to the buyer's payment of the applicable relay point shipping rates. For purchases of €99 or more (after discounts), this delivery method is free. The buyer will be informed by SMS and/or email when the order is available at the relay point. In case of excess packages or exceptional closure of the selected relay point, delivery will be made to the nearest relay point.
Exceptional delivery in the French overseas departments and territories and abroad: Any delivery to the French overseas departments and territories and abroad is systematically treated as "international delivery" according to the applicable postal rates on the order date. Outside the European Union, customs or import taxes may be added to the price of our products and remain the responsibility of the buyer. Therefore, it is the buyer's responsibility to inquire about the amount from their local customs office. We reserve the right not to accept or send orders depending on the destination; in addition, each of these requests will be subject to upfront payment based on a quote.
The products are delivered to the address specified by the buyer during the order. The buyer is responsible for providing all necessary information for successful delivery (phone number, exact address, door code, etc.). Otherwise, our company cannot be held responsible for delivery failure. In such a case, the products will be returned to our company's warehouse, and the buyer will need to contact our Customer Service department, whose contact details are provided on the site, to follow the procedures for recovering the ordered products. Our company disclaims any responsibility for the delay in the buyer's recovery of their products.
Shine guarantees that the Products are in perfect condition when handed over to the carrier. If the Products are damaged, your reservations must be made in writing to the carrier upon delivery or within 4 hours of delivery at the latest. A copy of these reservations must be sent to Shine by email to contact@sdtailing.com no later than 12 hours after the reservations are made.
If the above procedure is followed, and it is proven that the reservations are due to the fact that the package and products are damaged, Shine, at its discretion, will issue a credit note, refund the customer the price paid, or make a new delivery of similar products.
No unapproved return of products will be accepted.
Payments and Security
Payment for Products purchased on the site is made in full at the time of the order. Products remain the property of Shine until the order is fully paid.
Payments are made by credit card (MasterCard, Visa, American Express) or PayPal. Your credit card will be charged at the time of order confirmation (excluding the USA). To this end, you guarantee that you are the holder of the credit card to be debited and that the name on it is yours.
The payment security protocol used is 3D Secure. It guarantees total confidentiality of the personal information transmitted over the internet. Thus, the information related to your credit card is not stored on the site, and your payment can only be viewed in encrypted form through the SSL protocol (indicated by the appearance of "https" in the URL displayed in your browser).
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify, and oppose all of your personal data at any time by writing and providing proof of your identity by filling out the site's form.
Right of Withdrawal
In accordance with the provisions of Articles L.121-21 and following of the Consumer Code, after placing your order online, you have 14 business days from the date of delivery to exercise your right of withdrawal. If the deadline falls on a Saturday, Sunday, public holiday, or non-working day, it will be extended to the next working day.

Upon receipt of your request, customer service will contact you to arrange the return of the Products. Direct costs remain your responsibility.
Following contact with customer service, return the package containing the Product(s) to the address indicated above.
The refund will be made by check for mainland France or via the payment method used during the purchase as soon as possible after receipt of the returned Product(s) and no later than 14 days after their receipt.
The refund can only be made if the Product is returned in perfect condition, in its original packaging, accompanied by all its accessories, documentation, and the original purchase invoice. Products that are used, incomplete, damaged, or mixed in such a way that they cannot be separated from other products cannot be refunded.
The customer who placed the order is the only one who can exercise this right of withdrawal. In the event of delivery to a different person, this right cannot be exercised by the order recipient.

Retention of Title and Intellectual Property
In accordance with the law of May 12, 1980, the delivered products will remain the property of Shine until all your obligations have been fulfilled, and until the order is fully paid.
You only become the owner of the goods upon receipt of the merchandise.
All visuals, photos, texts, comments, works, illustrations, drawings, and images reproduced on the site are subject to copyright and intellectual property rights worldwide. Any total or partial reproduction of the site is strictly prohibited.
The buyer agrees not to use the products in a way that infringes on the rights of our company.
Shine disclaims any responsibility for unauthorized and/or improper use of these elements.
Liability
The products offered on the site comply with French legislation and the applicable standards in France. The photographs of the products on the site are provided for illustrative purposes and are therefore not contractually binding. The buyer is invited to refer to the description of each Product on the site to learn about its characteristics and, in case of doubt or if further information is needed, to contact Customer Service.
Shine disclaims all liability:
For any interruption, malfunction, or unavailability of access to the site;
For any misuse or misconfiguration of your computer;
For any damage of any kind resulting from fraudulent third-party intrusion leading to modification of the information provided on the site;
For any breach due to a fortuitous event or force majeure such as, but not limited to, disasters, strikes, fires, floods, equipment failures, transportation, communication issues, or your actions;
For any indirect damage, such as loss of profits, loss of data, customer loss, or other damages resulting from the use of the site, or the inability to use it.
In any case, Shine's liability, regardless of the cause, is limited to the lesser of the two sums: (i) the amount of the direct damage suffered by the customer or (ii) the price of the order.
Compliance and Warranty Against Hidden Defects
The Products are subject to the legal warranty conditions provided in Articles L.211-4 to L.211-14 of the Consumer Code.
Thus, in accordance with Article L.211-4 of the Consumer Code, Shine is obliged to deliver a product that conforms to the contract and is responsible for any non-conformities existing at the time of delivery. Shine is also responsible for any non-conformities resulting from the packaging, assembly instructions, or installation when it is contractually obligated or performed under its responsibility.
In accordance with Article L.211-5 of the Consumer Code, to be in conformity with the contract, the product must:
Be suitable for the purpose usually expected of a similar product and, where applicable:
Correspond to the description provided by the seller and possess the qualities presented to the buyer in the form of a sample or model;
Present the qualities that a buyer can legitimately expect given the public statements made by the seller, producer, or representative, particularly in advertising or labeling.
Or present the characteristics defined by mutual agreement between the parties or be suitable for any special purpose sought by the buyer, brought to the attention of the seller, and accepted by the latter.
However, you are solely responsible for choosing the Products, their storage from the time of delivery, and their use. Under no circumstances can SHINE SAS guarantee that the order will meet your specific expectations.
In accordance with the provisions of Articles 1641 and following of the Civil Code, Shine is subject to the warranty for hidden defects, i.e., "defects hidden in the product that render it unfit for the intended use or that significantly diminish its value, so that the buyer would not have acquired it or would have paid a lower price if they had known about it."
In case of legal warranty action for conformity:
In case of non-conforming delivery, you have up to 24 months from the delivery date to take action. Additionally, you are exempt from proving the existence of the non-conformity during the six (6) months following the delivery of the Products.
In case of non-conformity, you can choose between repair or replacement. However, the seller may not proceed according to the buyer's choice if this choice entails a manifestly disproportionate cost compared to the other option, given the value of the product or the significance of the defect. In that case, the seller is obliged to proceed with the option not chosen by the buyer, unless it is impossible to do so.
In the event of implementation of the warranty against hidden defects:
In accordance with Article 1644 of the Civil Code, you have the option to return the product and receive a refund or keep it and receive a partial refund, as determined by experts.
The action for redhibitory defects must be brought by the buyer within two years from the discovery of the defect, in accordance with Article 1648 of the Civil Code.
Applicable Law and Disputes
These T&Cs are written in French, which will be considered the sole language between the parties. The interpretation and execution of these T&Cs, as well as any acts arising from them, will be governed by French law, regardless of the place of delivery of the products, the location of the order, the nationality of the buyer, or their address. Any dispute with professionals and/or traders arising from these T&Cs and/or any order addressed to our company and/or any sale made by our company will be subject to the exclusive jurisdiction of the Commercial Court of St Etienne, even in the case of a warranty claim or multiple defendants or incidental demand.
Neither party will have failed in its contractual obligations if their execution is delayed, hindered, or prevented by a fortuitous event or force majeure. A fortuitous event or force majeure is defined as any irresistible, external, unpredictable, unavoidable event beyond the control of the parties that cannot be prevented despite all reasonable efforts. The party affected by such circumstances will notify the other within 7 working days of becoming aware of it. The parties will then consult within 30 days to assess the impact of the event and agree on the conditions for continuing the order. If the fortuitous event or force majeure lasts longer than 60 days, the order for products may be terminated by the affected party. Expressly, fortuitous events or force majeure are considered, in addition to those typically recognized by French courts and tribunals, as blocking of transportation means, delivery or supply failures, earthquakes, fires, storms, floods, lightning, and interruption of telecommunications networks.
